Returns: Only products originally shipped from TIKA or from an authorized supplier (drop-ship) will be considered for return to TIKA. By a Customer requesting a return of products to TIKA, the Customer certifies that the products were purchased from TIKA and there has been no substitution of the product from another supplier, distributor or other sources of the product. Any return must be in the original packaging and in unused condition except if approved for failure analysis/warranty evaluation by a TIKA sales representative via a Return Material Authorization (RMA).
Exchanges: Any item for exchange must be in new condition and in the original packaging. Exchanges must be requested within 30 days of ship date. Defective item(s) may be exchanged/returned for the same item. Items purchased from TIKA that have been used or altered and any items that have been sold as NC/NR (Non-Cancelable, Non-Returnable) will not be accepted for exchange. Non-Cancelable and Non-Returnable Items: Products listed as NC/NR status (Non-cancelable and Non-Returnable) are identified on the Cart Page for web orders and via Order Acknowledgement for all other orders.
Return Freight / Restocking Fee: TIKA reserves the right to charge cancellation and restocking fees, at a minimum rate of 30% to be deducted from the Customer refund. TIKA does not refund the original shipping and handling. The customer is responsible for all return freight charges. TIKA does not accept COD (Cash on delivery) shipments. Refunds: Upon receipt and inspection of returned item(s), TIKA will advise of the refund status. In the case of factory warranty or failure analysis, TIKA will issue any applicable credit pending manufacturer confirmation of failure. TIKA initiates credits via the original method of payment within 48 hours of approval. Refunds via credit card can take up to 10 business days to post to the account.

These Terms of Sale bind TIKA (“Seller”) and its customer (“Buyer”) regarding the sale by, and purchase from, TIKA of steel products (the “Goods”) in South Korea. “TIKA” refers
to the specific entity (such as TIKA South Korea) selling the subject Goods in South Korea. TIKA shall have no obligation to deliver Goods to Buyer except as set forth in an
order acknowledgement (an “Order Acknowledgement”). Buyer agrees that these Terms and Conditions of Sale (“Terms”) shall apply to all sales of Goods to Buyer. Acceptance
of any of Buyer’s orders, and any provision of credit to Buyer, is expressly made in reliance upon Buyer’s acceptance of these Terms. By accepting delivery of Goods from Seller,
Buyer agrees to be bound by these Terms of Sale unless otherwise set forth in a separate written agreement signed by Seller and Buyer.
1. REJECTION OF OTHER TERMS AND CONDITIONS. These Terms of Sale supersede all prior agreements, proposals and discussions between the parties with respect to the
purchase and sale of such Goods other than a written agreement signed by both parties. Any additional, inconsistent or different terms or conditions contained in Buyer’s
purchase order or other documents submitted to Seller by or on behalf of Buyer at any time, whether before or after the date hereof, shall be deemed a material alteration
and not a rejection of these Terms of Sale, and are hereby expressly rejected by Seller. These Terms of Sale shall be deemed accepted by Buyer without any such
additional, inconsistent or different terms and conditions, except to the extent expressly accepted by Seller in a writing signed by Seller. Unless otherwise specified, these
Terms of Sale shall continue in effect until the expiration of the applicable statute of limitations.
2. SHIPMENT; TITLE; RISK OF LOSS. All shipping dates are approximate and not guaranteed. Unless otherwise expressly stated in writing by Seller, title and risk of loss shall
pass from Seller to Buyer once the Goods are loaded on the first carrier at Seller’s facility, and all claims for loss or damage in transit must be filed against the carrier by
Buyer. Buyer shall pay freight, unless prepaid, and shall unload shipments promptly. Any increase in freight rates for shipments, whether prepaid or not, and all demurrage
shall be borne by Buyer.
3. PRICES. Unless otherwise specified in writing by Seller, all prices are exclusive of taxes, customs, duties, transportation and insurance, and any and all current or future tax
or governmental charge (including Federal Goods and Service Tax and Provincial Sales Tax) applicable to the sale, delivery, shipment or storage of the Goods that Seller is
required to pay or collect shall be for Buyer’s account, shall be added to the price and shall not be subject to reduction.
4. PAYMENT. may be made by check, money order, credit card, PayPal or wire transfer (all fees are borne by the Buyer). Where Seller has extended credit to Buyer, terms of payment
shall be net thirty (30) days from date of invoice, without offset or deduction unless otherwise noted. On any past due invoice, Seller may impose interest at the rate of one and a half percent
[1.5%] per month. If Buyer fails to make each payment when it is due, Seller reserves the right to change or withdraw credit and thereby suspend or cancel performance under any or all
purchase orders or agreements in which Seller has extended credit to Buyer. In the event of default by Buyer, Seller shall be entitled to costs, fees, and expenses, including but not limited to
recovery of attorney fees, court costs and fees, and collections costs.
5. SECURITY. TIKA may require Buyer to provide satisfactory security for the purchase price of Goods. Failure to provide such security entitles TIKA to defer any further
shipments until such security is provided or to cancel any Order Acknowledgement or so much of it as remains unperformed.
6. WARRANTY. UNLESS THE GOODS ARE SUBJECT TO AN EXPRESS LIMITED WARRANTY PROVIDED BY SELLER, THE GOODS ARE SOLD “AS IS, WITH ALL FAULTS”, WITHOUT
RECOURSE, AND SELLER DOES NOT MAKE, AND HEREBY EXPRESSLY DISCLAIMS, ANY AND ALL CONDITIONS, REPRESENTATIONS AND WARRANTIES OF ANY KIND
WHATSOEVER, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY CONDITIONS OR WARRANTIES OF OR AS TO MERCHANTABILITY OR
FITNESS FOR A PARTICULAR PURPOSE.
